General Terms & Conditions

These General Terms & Conditions (“GTC”) of Andreas Kern, acting under "Visco Werkstatt Kern" (hereinafter "Seller"), apply to all orders placed electronically, by telephone, by letter or email to the seller. Our GTC are recognized by the customer with every order. The inclusion of the customer's own conditions is hereby contradicted, unless otherwise agreed. Customers are both consumers and entrepreneurs. Consumers are natural persons who do not engage in any commercial or professional activity. Entrepreneurs are natural or legal persons or partnerships who act in the exercise of a commercial, self-employed or professional activity.

The product descriptions contained in the seller's online shop do not represent binding offers on the part of the seller but serve to submit a binding offer by the customer. The seller can accept the customer's offer within five days by sending the customer an order confirmation, or by delivering the ordered goods to the customer, or by asking the customer to pay after placing his order. If the seller does not accept the customer's offer within the aforementioned period, this is deemed to be a rejection of the offer, with the result that the customer is no longer bound by his declaration of intent.


PRICES / PAYMENT

The prices given are total prices which include VAT (20%). For orders, only payment in advance is considered agreed. Payments are due upon confirmation of the order or upon invoicing, at the latest upon delivery. The payment option(s) will be communicated to the customer in the seller's online shop.

In the case of deliveries to countries outside the European Union, additional costs may arise for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for delivery and shipping, legal import duties (e.g. customs duties) or the transfer of money by credit institutions (e.g. transfer fees, exchange rate fees). Such costs can also arise in relation to the transfer of funds if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.


DELIVERY / RESERVATION OF TITLE

All goods delivered remain the property of the seller until they have been paid for in full. The delivery of goods takes place on the dispatch route to the delivery address specified by the customer, unless otherwise agreed. If goods are delivered with obvious transport damage, the customer must immediately complain about such errors to the deliverer and notify us as soon as possible. Failure to submit a complaint or notification has no consequences for statutory warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.


WARRANTY / GUARANTEE

The warranty period is two years from delivery of the goods. During the warranty period, the customer has the right to free rework or replacement delivery (supplementary performance) due to defects. If the supplementary performance fails twice, the customer can request a reduction in price or withdraw from the contract.


WITHDRAWAL

If the customer is a consumer, he has the right to withdraw the contract within 14 days without giving reasons. The withdrawal period begins with the receipt of the goods. The right of withdrawal does not apply to consumers who do not belong to a member state of the European Union and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.

In order to exercise the right of withdrawal, the customer must inform the seller (Visco Werkstatt Kern, Andreas Kern, Dietersbergstrasse 41, 3110 Neidling - info@vw-kern.at) by means of a clear declaration (e.g. a letter sent by post, or E -Mail) of the decision to withdraw from this contract. A specific form is not required.

The return costs are to be borne by the customer and the goods must be returned in a salable condition. The goods are to be returned or handed over immediately and in any case no later than fourteen days after the cancellation. The customer must send the goods in the original packaging as far as possible in order to avoid claims for damages due to inadequate packaging. Payments that have already been made will be returned to the customer by the seller within fourteen days of receipt of the goods.


APPLICABLE LAW

The law of the Republic of Austria without the UN sales law applies to the contractual relationship between the seller and the customer as well as to the respective terms and conditions. If the customer is an entrepreneur, the place of jurisdiction is based on the registered office of the seller.
